18 U.S.C. § 2257 Statement

This statement concerns the record-keeping requirements of 18 U.S.C. §§ 2257 and 2257A and the regulations at 28 C.F.R. Part 75, as they relate to The Dynamic and the website and app at mydynamicapp.com (the “Service”).
1. Exemption
The operator of the Service is not a “producer,” primary or secondary, of any visual depiction of actual or simulated sexually explicit conduct as those terms are defined in 18 U.S.C. § 2257 and 28 C.F.R. § 75.1(c). We do not create, commission, direct, film, photograph, edit, curate, sell, or publicly distribute any such depiction.
All content in the Service is created and uploaded by its users into their own private space. Our activities in relation to that content are limited to transmitting, storing, and displaying it back to the two members of the dynamic it belongs to. Under 28 C.F.R. § 75.1(c)(4), a person whose activities are limited to the transmission, storage, retrieval, hosting, formatting, or translation of a communication they did not create is not a producer of that communication.
2. Nothing here is published
The Service has no public gallery, feed, marketplace, or discovery surface for images, and no image is ever visible outside the dynamic that created it. Each couple’s space is isolated from every other at the database level, and images are served through short-lived private links rather than public URLs. The one shared area of the Service, the community library, is text only and accepts no images at all.
3. Users are responsible for their own records
To the extent any user creates or uploads a visual depiction of actual sexually explicit conduct, that user is the producer of it. They are solely responsible for complying with 18 U.S.C. §§ 2257 and 2257A, including creating and maintaining any records the law requires of them. We neither hold nor have access to those records.
4. The age of everyone using the Service
Every account confirms a date of birth showing it to be 18 or over before the Service can be used, and that rule is enforced by the database rather than by the interface alone — see the Age Verification Policy. Content involving anyone under 18 is prohibited absolutely, and is reported to the National Center for Missing & Exploited Children and to law enforcement, as set out in the Content Policy.
